    Collection, Use, Disclosure and Retention

    Collection of Personal Information

    By making a donation, requesting information, or registering for an account on our website, you are giving FOI Canada permission to collect some of your personal information and to contact you by way of that information for the purposes outlined in this policy statement.

    The personal information that you voluntarily provide to FOI Canada is protected under the provisions of Canada’s federal privacy legislation.  Depending on the nature of the transaction, FOI Canada generally collects the following personal information from its users:

    • Full name

    • Account user name and password

    • Address (post and electronic)

    • Telephone number

    • Financial and payment information related to donations, including credit card information

    • Donation history

    FOI Canada may request demographic information such as your date of birth, gender and language preference for marketing and fundraising purposes, but you are not obligated to provide these.

    Personal information gathered by FOI Canada on visitors to its website is protected and not provided to third parties with the possible exception of third party suppliers with whom FOI Canada has entered into a contract that includes a confidentiality clause.

    Uses

    We use the information collected through FOI Canada’s website for the following purposes:

    • To facilitate donation collection and processing

    • To provide tax receipts for online donations

    • To allow users to create and manage accounts on this website

    • To communicate relevant news and updates

    • To administer pre-authorized recurring donations

    FOI Canada is committed to limiting the collection of personal information to that which is reasonably necessary for the identified purpose.     Disclosure

    Your personal information is not shared, sold, rented, traded, or otherwise disclosed to any outside third party except with your consent or where authorized and/or required by law. FOI Canada may use external services and suppliers to assist it in various functions, such as processing donations. Through agreements with these partners, and their commitment to protect your privacy, FOI Canada manages and protects your information with the same level of sensitivity as it does its own. All outside third parties that enter into business relationships with FOI Canada are required to adhere to this privacy policy, PIPEDA, and any other applicable law dealing with the protection of personal information.


    FOI Canada may have to disclose personal information to satisfy a law, regulation, or government request, or to satisfy a subpoena, search warrant, or court order.

    FOI Canada reserves the right to disclose and/or transfer personal information to a third party in the event of a proposed or actual sale, lease, merger, amalgamation, or any other type of acquisition, disposal, transfer, conveyance, or financing of all or part of FOI Canada in order for you to continue to receive the same services from the third party.

    Retention

    Personal information is retained by FOI Canada only so long as required by law or as is reasonable to fulfill the purposes for which it has been collected. Your consent to such purposes remains valid after termination of our relationship with you. FOI Canada may retain personal information as a matter of course for business record retention such as commercial transactions, donor management and program and/or service management.

    Collection of Non-Personal Information

    FOI Canada may also collect non-personal information about visitors to the website.

    When you visit FOI Canada’s website, we may automatically receive and temporarily store on our web server information that is supplied by your browser. Information automatically collected by FOI Canada’s web server includes the following:

    • Network location and the Internet Protocol (IP) address of the computer you are using to contact FOI Canada website;

    • Name of the domain you are using to access the Internet (e.g., ".com," ".org," ".net," and ".ca");

    • Type of browser you are using (e.g., Internet Explorer and Google Chrome);

In most circumstances, this is anonymous statistical data, and FOI Canada makes no attempt to link this data, or the IP addresses of the computers that have contacted its website, with the identity of the individual visiting the website—unless an attempt to damage the website has been detected or it is required by law. This automatic collection is never used to gather specific personal information, such as your name, your telephone number or your email address.

    Cookies

    Cookies are small files that may be placed on your hard drive by a website, without your knowledge, in order to monitor your use of the site. FOI Canada uses "persistent" and "session" cookies to monitor usage of its website. The cookies used do not allow FOI Canada to identify individuals. The cookies are compiled into statistical information on traffic patterns and are used to assess and improve the efficiency of its website.

    Session cookies are cookies that are used on some portions of FOI Canada’s website to store information within a session. During your visit to FOI Canada’s website, your browser exchanges information with FOI Canada’s web server. Session cookies facilitate this exchange by reminding the server which computer is making the request. No personal information is kept in session cookies, and session cookies are only stored in your browser's temporary (i.e., cache) memory. When you log out of your session, the session cookie is no longer valid; it is discarded when you close your browser.

    Persistent cookies are more permanent cookies that can be reread when you return to the website. The information in them is written onto your hard drive and remains there until the expiry date of the cookie or until you delete the file. Persistent cookies are used for tracking traffic patterns to and from FOI Canada’s website and are also used to find out how visitors access, navigate and use the website.     Google Analytics

    FOI Canada uses Google Analytics, a web analytics service provided by Google Inc. to help measure traffic patterns to, from, and within FOI Canada’s website. This analytics measurement tool uses "session" and "persistent" cookies to collect standard Internet log information and to track visitor behaviour in an anonymous form.     The information gathered by Google Analytics is then used to evaluate visitors' use of the website and to compile statistical reports on website activity for FOI Canada The aggregate data and statistical reports are only used to help FOI Canada make its website more useful to visitors and are only made available to web managers and other designated staff who require this information to perform their duties. Information collected for web analytics is not disclosed to any external third party service provider.

    Data collected for Web analytics purposes may go outside of Canada to Google servers and may be processed in any country where Google operates servers.     Use of Websites by Children

    FOI Canada does not solicit personal information from children on its website. Visitors under the age of majority, in particular those under the age of thirteen (13), are required to obtain parental or guardian consent before submitting any personal information to FOI Canada website.

Definitions in this Agreement

"Donations" includes any funds, monies, securities and other property donated to FOI Canada by a User or other Person;

“FOI Canada” means The Friends of Israel Gospel Ministry – Canada;

    Donations

    • Donations made through the Website are legally made to FOI Canada, a registered charity under the Income Tax Act of Canada (BN 8668 66684 RR0001), and it is FOI Canada that will issue your official charitable donation tax receipt.

    • Neither you nor any other Person may receive any tangible benefit or privilege in return for, or as a result of, making a Donation.

    Accuracy of Information

    • FOI Canada makes reasonable efforts to ensure that the information provided through the Website is current and accurate. FOI Canada makes no representations or warranties as to the accuracy, reliability, completeness or timeliness of such information.

    Intellectual Property

    5.1 FOI Canada owns all rights, title and interest in the Website and you acquire no interest therein. The materials provided on the Website including, without limitation, all content, site design, text, graphics and the selection and arrangement thereof are protected by copyright.     Indemnity

    8.7 YOU AGREE TO INDEMNIFY AND HOLD HARMLESS FOI CANADA AND ITS SERVICE PROVIDERS, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, ATTORNEYS, AND AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, DAMAGES, DEMANDS, LOSSES OR EXPENSES (INCLUDING ALL LEGAL FEES) BROUGHT BY YOU OR ANY THIRD PARTY ARISING OUT OF YOUR USE OF THIS SITE IN BREACH OF THIS OR ANY OF FOI CANADA’S POLICIES OR THE INFRINGEMENT BY YOU OF ANY INTELLECTUAL PROPERTY RIGHTS OF ANY PERSON OR ENTITY.


    Jurisdiction

    9.1 The laws of the Province of Ontario and any applicable federal laws of Canada shall govern your use of the Website. The courts of the Province of Ontario shall have exclusive jurisdiction over any dispute arising out of your use of this Website.


    General

    10.1 These Terms of Use, and any and all other notices, policies and statements contained on the Website (as the same may be amended by FOI Canada from time to time without prior notice) constitute the entire agreement between FOI Canada and you. It is a written agreement between FOI Canada and you. This Policy cannot be modified except as described elsewhere herein. This Policy supersedes anything in the Website inconsistent with this Policy. No delay or failure to exercise any right or any non-compliance by you, the user, with respect to the terms of this policy shall be construed as a waiver by FOI Canada. No waiver of any of this Policy shall be deemed a further or continuing waiver of such term or condition or any other term or condition.


    Severability

    11.1 If in any jurisdiction any part of this Policy is held, by a court of competent jurisdiction, to be invalid or unenforceable, such part of this Policy shall be restricted or eliminated to the minimum extent necessary with respect to that jurisdiction, and the remaining Policy shall otherwise remain in full force and effect. If such invalid or unenforceable provision may be modified to become valid and enforceable, such provision will be deemed to be modified so as to be valid and enforceable to the greatest extent allowed by law.


    Amendment of Terms

    12.1 You acknowledge that we may from time to time to amend, revise or otherwise modify any term of this Agreement in our sole discretion. We will post a revised version of the Agreement on the FOI Canada system. Your continued use of the FOI Canada system and/or services shall be evidence of your acceptance of any such modified Terms of Use of this Agreement.

    Entire Agreement

    13.1 This Agreement constitutes the entire understanding between the parties hereto and supersedes all previous communications, representations and understandings, oral or written, between the parties, with respect to the subject matter of this Agreement.

    13.2 In addition to accepting the Terms of Use set out in this Agreement by using the FOI Canada system or the services provided by FOI Canada or by making a Donation, when you communicate with FOI Canada by using its website or other technology involving the FOI Canada system as contemplated in this Agreement, those communications will be considered to be made "in writing" to the extent required for purposes of this Agreement.

    Effective: March 2023
